Abstract

This article examines the theoretical and practical aspects of the jury trial institution, its role in the criminal justice system, and the prospects for implementing this institution in the Republic of Uzbekistan. The study utilized comparative-legal, historical-legal, and analytical methods, which allowed for the study of foreign experience in the functioning of the jury court in Anglo-Saxon and continental legal systems, as well as in several post-Soviet states, including Kazakhstan, Russia, and Kyrgyzstan. A comparative legal analysis of foreign models of jury trials is conducted, identifying their advantages and disadvantages. The necessity of the gradual introduction of the institute of jury trials is substantiated, taking into account national legal and socio-cultural characteristics. It examines controversial issues regarding the correlation between the principles of establishing truth and adversarial proceedings, as well as the problems of ensuring the independence of jurors. Furthermore, the features of the classical and mixed jury trial models, their advantages, and potential challenges for practical implementation are analyzed. Based on the analysis conducted, the author concludes that it is advisable to gradually introduce the institute of jury trials for serious and especially serious crimes in Uzbekistan, taking into account national legal and cultural characteristics, the need to train personnel, create effective procedural guarantees, and improve the legislative framework.
