Abstract

This article provides a comprehensive analysis of the theoretical and practical problems of determining the grounds for family-law liability. It elucidates the essence and legal nature of family-law liability while substantiating its specific features, including its personal character, social orientation, and focus on protecting the rights and legitimate interests of family members, particularly minors. Furthermore, the article analyzes the distinct aspects of family-law liability compared to civil, administrative, and criminal liability, thereby defining its place within the legal system. The paper examines in detail the main forms of implementing family-law liability, with special attention paid to the deprivation and restriction of parental rights, liability for non-fulfillment of alimony obligations, declaring a marriage invalid, and the cancellation of adoption. The grounds, conditions, and legal consequences of applying these measures are analyzed in depth. At the same time, the article highlights emerging issues in law enforcement practice, notably the lack of a uniform approach and the insufficient effectiveness of child rights protection mechanisms. Based on the analysis of current legislation of the Republic of Uzbekistan, international legal standards, and judicial practice, proposals aimed at improving family law norms are presented. In particular, the study substantiates the necessity of clarifying the grounds for family-law liability, strengthening preventive measures, and enhancing the role of courts in safeguarding the rights of minors. The results can be utilized in academic research and law-making activities.
