Abstract

This article examines the constitutional and legal foundations of ensuring information security under the conditions of modern digital transformation. It analyzes how the concept and legal boundaries of information security are expanding due to the globalization of cyberspace, the increasing complexity of cyberattacks, the rapid development of artificial intelligence technologies, and the expansion of cross-border digital platforms and foreign digital infrastructures. Information security is highlighted as a complex constitutional and legal institution that, alongside protecting the interests of the state and society, is inherently linked to safeguarding personal data, privacy, freedom of information, and other fundamental rights. The study establishes the legal balance between state digital sovereignty, digital jurisdiction over cross-border digital activities, and the protection of human rights as its primary research vector. In particular, it substantiates that foreign digital platforms and infrastructures can exert a significant impact on citizens, information resources, digital infrastructure, and national interests without maintaining a physical presence in the territory of Uzbekistan. On this basis, the article proposes formalizing digital jurisdiction as an independent legal institution within national legislation. As a result of the study, a concept for shaping a modern constitutional-legal model of information security based on the triad of “digital sovereignty – digital jurisdiction – human rights” is advanced.
