SYSTEM AND EFFECTIVENESS OF THE SOURCES OF DIPLOMATIC LAW OF INTERNATIONAL ORGANIZATIONS

This article provides a profound scientific and theoretical analysis of the sources, systemic structure, and practical impact of diplomatic law within the context of the sharp increase in the role and sphere of influence of international organizations within the system of modern international relations. The main objective of the study is to highlight the specifics of the system of sources of diplomatic law in international organizations, address existing theoretical and practical problems in the process of international lawmaking, and identify the differences between the source of law and the form of law. Systematic analysis, comparative-legal, historical-legal, formal-legal and empirical observation methods were widely used in the coverage of the issue. As a result of the study, it has been theoretically and practically substantiated that international organizations are not only a platform for interstate dialogue and cooperation, but also an independent legal norm-creating entity that has a significant impact on global development. Also, in the course of the research, narrow and broad approaches were analyzed, and it was proved that the basis of the source of international law is the agreed will of the subjects. The obtained scientific results can be applied in the practice of modern international relations, in the legal regulation of the activities of international intergovernmental organizations and diplomatic missions, as well as in the further improvement of the regulatory and legal framework of international law. In conclusion, it should be noted that the concept of the source of diplomatic law of international organizations fully covers the forms of expression of law, the agreed common will of the participants, the means of creating legal norms, and the process of forming norms itself, and this process is manifested through the conclusion of contracts or the adoption of decisions.
