IMPROVING LIABILITY MEASURES FOR CRIMES INVOLVING THE ILLEGAL HANDLING OF NARCOTIC DRUGS, PSYCHOTROPIC SUBSTANCES, AND THEIR ANALOGUES

Abstract

The article discusses the problems of law enforcement practice in crimes of illicit trafficking in narcotic drugs, psychotropic substances, and their analogues, reveals the features of public danger, the need for implementation of international documents, as well as prospects for improving liability for this type of crime. Based on the results of the study, existing gaps and contradictions were identified in the regulation of criminal legislation providing for liability for crimes of illicit trafficking in narcotic drugs or psychotropic substances. In particular, the composition of the crimes provided for in Chapter XIX of the Criminal Code is of a blank nature, but these norms contradict the norms of the Law of the Republic of Uzbekistan «On Narcotic Drugs and Psychotropic Substances», which determines their content, as well as the complexity of the structure of the norms defining responsibility for this type of crime. Some norms establish responsibility for various types of crimes, and in the practice of applying the law, mistakes are made when applying most of the signs aggravating responsibility for these types of crimes. In addition, the criminal law does not establish criminal liability for certain socially dangerous acts, and some requirements of international legal documents in the field of drug control are not implemented in national legislation. At the same time, these situations lead to inefficiency in combating crimes of illicit trafficking in narcotic drugs or psychotropic substances and to uneven application of this type of criminal law in practice. Based on this, the article puts forward proposals and recommendations aimed at improving the effectiveness of combating crimes of illicit trafficking in narcotic drugs or psychotropic substances and eliminating the identified problems and shortcomings.
