JUDICIAL PRACTICE OF VERIFYING COMPLIANCE WITH THE ADMINISTRATIVE PROCEDURE

Abstract

The article touches upon the issues of application of the Administrative Procedural and Procedural Code of the Republic of Kazakhstan in specialized administrative courts, assessing the legality of administrative acts and administrative actions through the prism of procedural requirements and principles of administrative procedures. The issues of the judicial practice of checking the legality of administrative acts are covered. The legal relations of public authorities with citizens and legal entities and the algorithm of actions of an administrative body in the public-law sphere on the implementation of its powers in relation to citizens and organizations are considered. Several types of administrative procedures are singled out. It is noted that in the country there is no institute of nullity of administrative acts; a contested administrative act is considered legal until it is recognized as illegal by a higher body or court.
