Abstract

This article is devoted to a comprehensive analysis of the object and subject of human trafficking from a criminal-legal point of view. In the study, human trafficking is assessed as a complex socio-legal phenomenon that poses a serious threat to human rights and freedoms in modern society. The author illuminates the essence of the concepts of object and subject in the theory of criminal law, consistently investigating them on the example of the crime of human trafficking. The article substantiates that the direct object of this crime is the social relations that ensure the personal freedom, honor, dignity, and inviolability of a person. Also, within the framework of the subject of the crime, the legal status of the victim and the significance of issues of his will and consent in the qualification of the act are considered. In the course of the research, a comparative analysis of the norms of national legislation, materials of judicial practice, and international legal documents was carried out. The author put forward scientific conclusions and proposals aimed at improving law enforcement practice and strengthening preventive measures. The research results have important theoretical and practical significance in the development of mechanisms for combating human trafficking, the correct qualification of crimes, the effective protection of the rights of victims, and the consistent improvement of legislation. This article serves as a methodological resource for scientific research and contains important practical recommendations for specialists in the field.
